Welcome to SpaBerry (referred to as “we,” “us,” “our,” or “the Company”). By purchasing through our website, you (“the customer”) agree to the following terms and conditions governing the sale, purchase, and delivery of our products.

Order Status & Tracking

Aftermarket Products

All orders placed from Monday to Friday (excluding public holidays) will be processed and shipped within 2 working days upon confirmation of payment, from our warehouse. This could vary with circumstances such as online security checks, shipping restrictions, payment authorization, packing and dispatching of order. An email confirmation will be sent for all orders once received.

Once the order has been dispatched, an email confirmation will be sent to you with the tracking number. You may check and track the delivery status of your orders via your "my account" tab.



In-Stock SpaBerry Hot Tub Products

We are committed to providing a seamless and transparent online shopping experience. As such:

  • All products listed for sale as “In-Stock” are in physical inventory and available for immediate shipment.
  • No product will be listed as “In-Stock” unless it is on hand and ready to ship from our Canadian warehouse.

This policy eliminates uncertainty around availability and delivery timelines.



Special Order SpaBerry Hot Tub Program

Customers interested in custom configurations, color choices, or accessory packages can place an Online Order which is clearly shown as a special order product under the following conditions:

  • Special orders are priced to reflect the additional logistics, lead time, and handling involved.
  • No deposit or upfront payment is required.
  • The customer will be notified once the special-order product arrives and is available in stock.
  • Once the product is available at our warehouse the customer can choose to complete the purchase.
  • If the customer no longer wishes to proceed with their purchase, no obligation or penalty will apply.

We believe this approach reflects the best industry practices for fairness and customer protection.



Taxes, Duties & Tariffs

For all international orders, you will need to pay for all import taxes, duties and tariffs (if any) as per your country’s governing laws in order to clear customs.

We offer SSL secured payment on our website and do NOT store any credit or debit card information. We accept payments via the following options:



Refund & Cancellation Policy

In-Stock Products

  • Orders for in-stock items may be cancelled before the product has shipped for a full refund.
  • Once shipped, all sales are final, except where required by law.
  • Any damage or warranty issue will be handled through our Product Warranty & Service Policy, available upon request or via our website.

Special Orders

  • No payment is taken until the item is physically available in stock.
  • Once paid, the same Final Sale policy applies to special orders, as the product is being held specifically for the customer.


Shipping & Delivery

  • We only ship within [Canada/USA/EU/UK].
  • Shipping timelines are disclosed at the time of purchase and based on in-stock inventory.
  • Once shipped, tracking details will be provided. Delivery times are subject to carrier performance and external conditions.


Force Majeure / Unforeseen Delays

While our in-stock model eliminates most supply chain risks, the Company is not liable for delays caused by circumstances beyond our control, including but not limited to:

  • Acts of God, floods, hurricanes, tornadoes, natural disasters, delays in manufacturing, parts shortages, strikes, shipping delays, pandemics, port closures, manufacturing holidays, manufacturing shutdowns, government imposed pandemic regulations etc.
  • These conditions, if applicable, do not give rise to automatic cancellation or refund rights unless otherwise stated herein.


Privacy & Data Protection

We are committed to full compliance with PIPEDA and relevant provincial privacy laws. Your information will never be shared, sold, or disclosed to third parties, except as required for order fulfillment or legal obligations. Our full privacy policy can be viewed here



Dispute Resolution

In the event of a dispute, we aim to resolve all concerns fairly and efficiently. Customers agree to:

  • First contact our support team at SpaBerry at 855-441-0550 for resolution or use our online form
  • Allow reasonable time for investigation and resolution.
  • If unresolved, all claims will be governed by the laws of the Province of Alberta and subject to arbitration or the jurisdiction of Alberta courts.


Modifications to Terms

We reserve the right to amend these Terms & Conditions at any time. All changes will be posted on our website and effective immediately upon posting. Continued use of our services constitutes agreement to the updated terms.
